I’m thrilled to share that my work as a top immigration lawyer at MyVisa® has gained significant recognition in the media. Over the years, my expertise and achievements have been featured in esteemed news outlets such as SBS, ABC News, The Guardian, and The Australian Newspaper.
As a migration tribunal lawyer with over 25 years of experience, I have successfully guided clients through complex immigration matters. Leading a dedicated and passionate team, I personally ensure that every application is carefully reviewed and handled with the attention it deserves.
My goal is to provide effective, results-focused representation to help you achieve your immigration objectives. Whether you need advice or representation, I am here to guide and support you through every step of the process..
Skilled (Provisional) (Class VC) Visa.
As a Federal Circuit Court lawyer, I’ve had the privilege of representing many clients who needed assistance after errors were identified in tribunal immigration matters.
My experience navigating the complexities of the Federal Circuit and Family Court of Australia has equipped me to effectively advocate for my clients' rights and interests.
This court differs significantly from the tribunal, making it crucial to have representation by an Australian legal practitioner to maximise your chances of success. Consult with me first to determine if your case is worth taking to court or if it may be a waste of time. Given the potential costs involved, obtaining honest and clear advice before proceeding is essential.
As a Federal Court lawyer, I’m well-versed in the three common pathways for immigration appeals to the Federal Court of Australia. Whether you’re navigating a judicial review, an appeal on a question of law, or seeking to challenge a tribunal decision, I’m here to guide you through each step of the process and ensure your case is handled with the utmost care and expertise.
The first is if you sought review in the tribunal and were unsuccessful, then appealed to the Federal Circuit Court and were also unsuccessful. The second is if you have a decision made personally by the minister. The third is if you have a matter in the general division of the tribunal; in this case, you typically appeal or make an application directly to the Federal Court of Australia rather than the Federal Circuit Court. These cases often involve cancellations under section 501 of the Migration Act, particularly when the tribunal’s decision contains a legal error. Identifying whether a legal error exists is crucial. Book a consultation with me to discuss the merits of taking your immigration matter to the Federal Court or exploring alternative pathways to stay in Australia.
I’m pleased to have been appointed as an Advisory Group lawyer. This role allows me to bring my expertise to the table, contributing valuable insights and guidance to the Advisory Group's important work.
The Assistant Minister appointed 26 experts to the Advisory Group following a public nomination process, for a maximum term of 12 months:

I’m Nilesh Nandan, a leading immigration lawyer in Australia and the Head of Practice at MyVisa® Lawyers. With over two decades of experience, I have helped thousands of individuals, families, and businesses navigate the complex Australian immigration system.
My passion for immigration law is deeply personal. In 1976, my family and I migrated to Australia by boat, shortly after the abolition of the White Australia Policy. That journey—filled with uncertainty, challenges, and the determination to build a new life—shaped my commitment to helping others achieve their own Australian immigration goals.
If you’re looking for an immigration lawyer in Australia who understands both the legal and human sides of migration, you’re in the right place.
My journey into law began in Brisbane, Australia, where I attended Brisbane Grammar School before pursuing a career in law and business.
I hold:
✅ Bachelor of Business (Accounting) & Bachelor of Laws (LLB) – Queensland University of Technology (QUT)
✅ Graduate Diploma in Legal Practice (GDLP)
✅ Master of Business Administration (MBA – International Business)
Since being admitted as a lawyer in 1993, I have dedicated my career to immigration law in Australia. My expertise in business, accounting, and law allows me to handle both individual and corporate migration cases with precision.
In 1999, I founded MyVisa®, an immigration law firm dedicated to helping visa applicants and sponsors with visa applications, refusals, cancellations, and appeals.
My first office? A bench in a shared cubicle above a chicken shop in Brisbane. But my focus was never on fancy offices—it was on delivering clear, practical, and results-driven immigration advice.
Today, MyVisa® has grown into a national firm, with offices in:
✅ Sydney
✅ Melbourne
✅ Brisbane
✅ Perth
We assist clients across Australia and globally, offering in-person and virtual consultations to provide legal representation no matter where you are.
