Hi, my name is Erika and I am in the process to apply for a partner visa but my partner is not sure if he sponsor his ex partner or no previously. They had a child together but at the end she got the full custody, they separated and we don’t know if she got PR or not, but she still in Australia. My question is, I consulted a laywer previously and he suggested to fill this form but I don’t know how to request the information because as I understand is about personal details. Should I request if my partner has any background history sponsoring someone from overseas or something more related with his ex partner? If you could help me with it I’d appreciate it. Thank you
Dear Erika,
Apologies for the delayed response, but I hope this answer will still benefit the wider immigration-seeking community.
In your situation, if your partner is uncertain about whether he previously sponsored his ex-partner for permanent residency, you can request this information from the Department of Home Affairs. It would be important to confirm whether any sponsorship history exists because it may impact his ability to sponsor you for a partner visa. There are limits on how many times a person can sponsor a partner and how often, so it’s essential to clarify this.
You can request information about your partner’s sponsorship history through a Freedom of Information (FOI) request. This allows you to obtain relevant records, including any sponsorship applications he may have lodged in the past. This is a formal process, but it will give you the details needed to determine whether his previous sponsorship affects your current application.
