The Minister for Immigration has appealed the decision in favour of visa cancellee Ms Le, handed down by his Honour Justice Logan in the Federal Court. His Honour’s decision quashed the decision of the Minister to cancel Ms Le’s permanent residence visa, using the so-called section 501 power. The section 501 cancellation is provided for by Section 501 of the Migration Act.

This matter is now before the Full Federal Court of Australia. The Respondent’s submissions in relation to this matter were served and filed by MyVisa Lawyers on Thursday.

The Minister is to make submissions this week.
